The Federal Supreme Court dismisses the appeal.

The appellant had been informed of the requirements regarding the controllability of working hours, failed to comply with them, and did not ask the competent authority about the conformity of its system. In the assessment of good faith, case law does not in principle protect companies that did not comply with the obligations regarding the controllability of working hours.

The court costs of CHF 6,000 are imposed on the appellant.
