The Federal Council is tasked with drawing up a proposal that creates the legal possibility of temporarily suspending the right to submit an asylum application for individual groups of persons. Groups of persons from regions from which economic refugees predominantly come to Switzerland should already be turned back at the Swiss border. At the same time, persons assigned to such a group who do not have a valid Schengen visa should be denied transit.

Justification:

The crossing of the border by persons from states with an overwhelming majority of economic refugees and with a crime rate of over fifty per cent violates the constitutional protection of the country’s own population and its property. This protection, too, must be guaranteed by international treaties and conventions. In a balancing of interests, legal provisions must therefore be created that can place the protection of the country’s own population above international asylum rules. This can only be achieved with a new legal basis and, if necessary, with related unilateral declarations concerning international treaties and conventions. The Federal Council should submit to Parliament a corresponding proposal on how the right to submit asylum applications can be restricted.
