Residence-law protection for victims of violence – lessons from the Frei case

· Bundesklar Redaktion

Since 1.1.2025, Art. 50 FNIA has been extended in cases of domestic violence. The question arises as to how the provision is applied and whether it ensures adequate protection. It is unclear to what extent Art. 30 letter b FNIA provides protection in cases of sexualised and gender-based violence. How many residence permits of persons with experience of domestic violence are each year challenged in writing, not extended or revoked? Are these cases recorded by residence status, sex and canton? How many permits are issued under Art. 30 letter b FNIA and Art. 50 FNIA? Please report them separately.
