6B_240/2026 – Judgment of 18 August 2026

· Bundesklar Redaktion

The court expels from Switzerland for 5-15 years, irrespective of the sentence imposed, the foreign national convicted of sexual acts with children and pornography involving actual sexual acts with minors ( Art. 66a para. 1 lit. h SCC ). Mandatory expulsion for a catalogue offence within the meaning of Art. 66a para. 1 SCC generally applies irrespective of the specific seriousness of the offence ( BGE 144 IV 332 E. 3.1.3). Mandatory expulsion may be waived only “ausnahmsweise” (exceptionally) where the cumulative conditions are met that (1.) it would result in a serious personal hardship case and (2.) the public interests in expulsion do not outweigh the foreign national’s private interests in remaining in Switzerland ( Art. 66a para. 2 first sentence SCC ; the hardship clause).
