Federal Supreme Court confirms cost order after criminal proceedings were discontinued

Decision

The Federal Supreme Court dismisses a man's appeal. It confirms the cost order of CHF 1'236.05 under Art. 426 para. 2 CrimPC and also denies compensation.

Reasons

According to the judgment, the blow that perforated the eardrum and caused the wife to fall was disproportionate and unlawful compared with a light slap. The Court held that negligence is sufficient if the blow was capable of causing the established injury.
