Federal Supreme Court orders fresh review of pretrial detention

The Federal Supreme Court sets aside a decision on pretrial detention and remits the case to the Geneva appellate chamber. It finds that the risk of collusion is insufficient; factual findings and reasoning were insufficient regarding the risk of absconding and the qualified risk of reoffending. Immediate release was denied.

Decision on pretrial detention

The Federal Supreme Court partially upheld the appeal, set aside the challenged detention decision and remitted the case to the Geneva appellate chamber for a fresh review.

Reasoning

The Federal Supreme Court found that there was no sufficiently concrete and substantiated risk of collusion. The factual findings and reasoning were insufficient regarding the risk of absconding and the qualified risk of reoffending.
