Federal Supreme Court dismisses state liability action concerning Russian expropriation

Judgment

The Federal Supreme Court dismisses the state liability action insofar as it is admissible.

The claimant sought damages from the Swiss Confederation for the expropriation of its shareholder rights in a Russian company by Russian authorities. The Federal Supreme Court finds that this sovereign act cannot be attributed to Switzerland and does not give rise to liability of the Swiss Confederation under Art. 3 LRCF.

Court costs of CHF 50,000 are imposed on the claimant.
