Business 26.7678: TPA/Epidemics Act: Divergent legal situation between two acts
Under Art. 47d TPA, manufacturers of medical devices are required to have sufficient financial coverage for defective medical devices. The Epidemics Act contains no such provision. The Confederation may even undertake to cover the damages. As a result, the manufacturers will NEVER and the state/the taxpayer will ALWAYS bear the damage. Does the Federal Council not also agree that vaccines should be treated exactly like other medical devices? If so, what should a corresponding provision in the Epidemics Act look like?
