The Federal Council is requested to answer the following questions: How does it assess today the fact that there is still no legal basis for compensation payments to the host region of a deep geological repository and that those responsible for waste disposal are not legally obliged to make such payments? Does it stand by its assessment in the report of 7 October 2015 on Postulate 13.3286, according to which statutory regulation was not necessary? If so, how does it justify this in view of the site proposal that has since been specified, the general licence applications that have been submitted, and the compensation negotiations that are beginning? How does the Federal Council justify the fact that a host region should make a special contribution to solving a national task regulated by law, while its entitlement to compensation for doing so is not legally secured – although it is provided for in the Sectoral Plan procedure? What consequences would there be if those responsible for waste disposal did not pay any compensation or if the negotiations ended without an agreement? Does it see a need to enshrine in law principles for transparent, intergenerationally equitable use and management that benefits the host region in the long term? What possibilities does it see for creating, in the Nuclear Energy Act, an entitlement to appropriate compensation and a fallback mechanism in the event of failed negotiations, without pre-empting the negotiation of the amount, distribution and specific use?
