The Federal Supreme Court partially upholds the appeal, sets aside the decision of the Ticino Compulsory Measures Court and remands the case for a new decision.

Legal professional privilege and protective measures

Defence counsel who is also accused in the same factual context cannot invoke legal professional privilege to prevent unsealing and seizure. Measures are required to protect the client so that the official conducting the client’s proceedings does not become aware of the documents.
