COPIL examines whether, in addition to the criteria already taken into account, further criteria could determine the selection of sites for the use of wind energy. Its task is to make recommendations to the Council of State on the sites that should be taken into account in wind energy planning. According to the Federal Supreme Court, this does not make COPIL an authority whose members make or prepare a decision. According to the ruling, decision-making power for wind energy planning remains exclusively with the Council of State.
